Sono numerose, infatti, le questioni che si sollevano in relazione a questo ambito di studio, arricchito dalle recenti iniziative prese a livello europeo (dalla proposta di regolamento europeo sull\u2019IA, attualmente in discussione al Consiglio, alla Risoluzione del Parlamento europeo del 6 ottobre 2021 sull\u2019utilizzo dell\u2019IA da parte delle autorit\u00e0 di polizia e giudiziarie in ambito penale). Le nuove modalit\u00e0 d\u2019aggressione a beni giuridici che potranno emergere dall\u2019utilizzo e dal funzionamento di tali sistemi porteranno ad interrogarsi sull\u2019adeguatezza dell\u2019apparato normativo di tutela penale previsto nei diversi ordinamenti, nonch\u00e9 sull\u2019opportunit\u00e0 di eventuali interventi di criminalizzazione. Il diverso grado di autonomia dei sistemi di IA, la loro \u201copacit\u00e0\u201d e, per quelli pi\u00f9 sofisticati, la loro imprevedibilit\u00e0 rendono non sempre agevole la riconducibilit\u00e0 dei fatti illeciti causati dal loro impiego ad un agente umano. Infine, dovr\u00e0 considerarsi l\u2019utilizzo degli applicativi di queste tecnologie nell\u2019ambito delle attivit\u00e0 d\u2019indagine e del processo penale.<\/p>\n<p>&nbsp;<\/p>\n<p>The conference will debate the<strong> issues that criminal law must address in case of harms related to the use of Artificial Intelligence (AI) systems<\/strong>. There are numerous concerns being raised in relation to this area of study, which has been enriched by recent initiatives taken at the European level (from the proposal for a European regulation on AI, currently under discussion in the Council, to the European Parliament Resolution of October 6, 2021, on the use of AI use by the police and judicial authorities in criminal matters). The new modes of aggression and violation of human rights that may emerge from the use and operation of such systems will lead to the need to assess the adequacy of the regulatory apparatus of criminal protection provided in different legal systems, as well as the convenience of possible criminalization. The degree of autonomy of AI systems, their \u201copacity,\u201d and, for the more sophisticated ones, their unpredictability, make it not always easy to attribute the harmful outcomes caused by their use to a human agent.
